Welcome to Apiarium. These Terms of Service ("Terms") govern your access to and use of apiarium.dev and our API services (collectively, the "Service"), operated by Apiarium ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service
Apiarium provides a unified REST API that gives developers access to multiple third-party AI models — including text generation, image generation, text-to-speech, and audio transcription — through a single API key.
2. Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your API key and account credentials, and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use.
You must be at least 18 years old to use the Service.
3. Plans, Credits & Billing
The Service is offered under Free, Starter, and Pro plans, each with a monthly credit allowance. Credits are consumed based on usage and do not roll over between billing cycles unless explicitly stated.
Paid plans are billed in advance on a recurring basis through Stripe. By subscribing, you authorize us to charge your payment method automatically each billing period.
You may upgrade, downgrade, or cancel your subscription at any time from your dashboard. Cancellations take effect at the end of the current billing period; we do not provide partial refunds for unused time, except where required by law.
If a payment fails, we may suspend access to paid features until the issue is resolved.
4. Acceptable Use
You agree not to use the Service to:
Generate content that is illegal, harmful, or violates the rights of others
Attempt to circumvent rate limits, credit limits, or plan restrictions
Reverse-engineer, resell, or sublicense API access without authorization
Use the Service to build a product that directly competes with Apiarium by reselling raw access to the same underlying models without added value
Send excessive or abusive traffic intended to disrupt the Service
We reserve the right to suspend or terminate accounts that violate these terms.
5. Third-Party AI Providers
Apiarium routes your requests to third-party AI providers, including OpenAI and Anthropic, to generate responses. Your use of the Service is also subject to the acceptable use policies of these providers. We are not responsible for the availability, accuracy, or behavior of third-party models, including changes, deprecations, or outages on their end.
6. Content & Outputs
You retain ownership of the inputs you submit and the outputs generated through the Service, subject to the terms of the underlying AI providers. AI-generated content is probabilistic and may contain inaccuracies, biases, or errors. You are solely responsible for reviewing and verifying any output before relying on it for business, legal, medical, financial, or other consequential decisions.
We do not claim ownership over your content, and we do not use your API requests to train our own models.
7. Intellectual Property
The Apiarium name, logo, website, and underlying software are our property and may not be used without permission. These Terms do not grant you any rights to our intellectual property beyond what's needed to use the Service.
8. Availability & Changes to the Service
We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features of the Service at any time, including in response to changes made by our third-party AI providers (such as model deprecations).
9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Apiarium shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including damages resulting from AI-generated content, third-party provider outages, or data loss. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.
12. Governing Law
These Terms are governed by the laws of Spain, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a notice on this page. Continued use of the Service after changes constitutes acceptance of the updated Terms.
